Man who raped underage stepdaughter gets double life sentence in Colonial Heights court

COLONIAL HEIGHTS, Va. (WRIC) -- A man has been given a double life sentence in Colonial Heights after raping his underage step-daughter repeatedly, resulting in the birth of a child.

Bobby Gerard Clary was convicted and sentenced on two charges of rape by force, threat or intimidation, according to an April 29 press release from the Office of the Commonwealth's Attorney for Colonial Heights.

Clary was given one life sentence for each count of rape after a Colonial Heights jury heard testimony from the step-daughter regarding "nightly rapes by the defendant, resulting in the birth of a child," according to the office.

The city's Deputy Commonwealth's Attorney, Noelle Nochisaki, argued that Clary groomed his underage stepdaughter, saying he "preyed upon and impregnated [her]." DNA evidence was provided that proved the victim's child was Clary's.

"That man, who was supposed to protect her and prevent this from happening, is the man who violated her and her trust," the office said.

Nochiaski also argued that Clary felt no remorse for his actions.

During sentencing, Colonial Heights Circuit Court judge Steven Novey said "every night, [the victim] endured a monster," per the office. Novey continued by saying that, while he did not believe any of Clary's "multiple stories," he "never doubted" the credibility of the victim, whom he described as a "brave" and "resilient young lady."

"We agree with the Court that the victim is a brave and resilient young lady, who had the courage to stand up against her abuser and rapist," said the city's Commonwealth's Attorney, Gray Collins.
